Will and Codicil of Mathias Trumbo Deceased

I, Mathias Trumbo of the town of Rutland, County of LaSalle, and State of Illinois, being mindful of the uncertainty of this life and being of sound mind and memory, do hereby make ordain publish and declare this as my last will and testament, hereby revoking all former wills by me made,

First it is my will that all my funeral expenses and just debts be fully paid by my executors hereinafter named,

Second I desire that my son Elias Trumbo shall have the following described real estate viz: beginning at the middle of the east side of Section Twenty Eight (28) Township Thirty-four (34) North of Range Four (4) East of the 3d P. M. and running thence South 30 min, East distance 20 chains to find the middle of the South East quarter of said section Twenty-eight (28) which is properly the place of beginning, thence North 63 degrees west 19 chains and 67 links, thence North 42 degrees west distance 14 chains and 88 links, thence North 59 degrees west distance 14 chains and 90 links, thence South 30 minutes to the quarter Section corner 7 chains 51 links thence South 30 minutes east distance 20 chains, thence East to the place of beginning distance 40 chains containing Fifty-two (52) acres Also the South West quarter of the South West quarter of Section Twenty Seven (27) in the Township and range aforesaid containing Forty (40) acres, Also the South West quarter of the South East quarter of said Section Twenty Eight (28) in Township and range aforesaid containing Thirty (30) acres, and the South half of the South west quarter of said Section Twenty Eight (28) containing Eighty (80) acres, being in all Two Hundred and two (202) acres, for which my said son Elias Trumbo shall pay to my executors hereinafter named at the rate of Twenty five (25) dollars per acre, in payments as follows, One Thousand dollars in one year after my decease, and one thousand dollars annually thereafter until all is paid, the said Elias Trumbo to retain out of the payments aforesaid his distributive share Thereof as an heir to my estate,

Third, To my daughter Elma Anna Robinson [sic, Robison] I give and bequeath the usual outfit given to my other daughters when married viz: One (1) good horse, Two (2) cows, two (2) good beds and bedding, One (1) bureau, one (1) set of chairs, one (1) Table and Table ware, In case any of the articles so bequeathed to her are not on hand at my decease, my executors shall purchase the required ones for her out of any money belonging to the estate,

Fourth, All the residue and remainder of my property both Real and Personal not hereinbefore bequeathed, I give and devise to my children, to be equally divided among them, Share and Share alike, that is to say, to my daughter Livina Matlock one Seventh, to my son Elias Trumbo one Seventh, to my daughter Eliza Gibson one Seventh, to my daughter Barbara Jackson one Seventh, to my daughter Elizabeth Strawn one Seventh, to my daughter Elma Anna Robinson [sic, Robison] one Seventh, and to the heirs of my deceased daughter Isabella Green one Seventh. It is my will that the said heirs of Isabella Green dec’d shall not receive their shares until the son Newton shall arrive at the age of twenty-one years, and the daughter Clarrissa at the age of Eighteen (18) years,

Fifth In case my Executors shall deem the property devised by Section Fourth of this will unsusceptible of division as therein contemplated, they are hereby empowered to make sale of either the real or personal estate or both therinmentioned, on the best terms possible, in which event they are required to divide the proceeds arising from the sale thereof among my said children and the heirs of said Isabella Green, dec’d according to my intention expressed in said Fourth Section,

Sixth, I hereby nominate and appoint my son Elias Trumbo and my son-in law West Matlock executors of this my last Will and Testament.

In Witness whereof I have hereunto set my hand and Seal this Ninth day of November in the year of our Lord, one thousand Eight hundred and Sixty five

The above instrument consisting of one sheet was at the date thereof signed & sealed by said Mathias Trumbo the testator therein mentioned in our presence and he at the same time declared the same to each of us to be his Last Will and Testament and that thereupon at his request, and in his presence, and in the presence of each other we have hereunto subscribed out names as attesting witnesses

Whereas I Mathias Trumbo have made my last will and testament in writing bearing date the Ninth day of November in the year of our Lord one thousand Eight hundred and Sixty five, Now therefor I do by this my writing which I hereby declare to be a codicil to my said will and testament and to be taken as a part thereof, order and declare that my will is that the sum of One Hundred dollars shall be paid from my estate and invested for the following purpose to wit: The Ornamenting, beautifying and Keeping in Good Order the Grave Yard and its surroundings, said Grave Yard being situated in Section Twenty Seven, Township Thirty four North in Range Four East in the Town of Rutland LaSalle County, Illinois and I further declare that it is my will that at my decease the executors of my last will and testament shall pay the said sum of One Hundred Dollars to the trustees of said Grave Yard, if any trustees shall at that time have been appointed, but if not than said Executor shall invest said sum of one Hundred dollars to be held in trust, till the appointment of trustees for said Grave Yard – to whom said sum shall be paid for the uses and purposes mentioned above, and I further declare that it is my will that the said trustees shall expend only the interest on said sum of One Hundred dollars in the purposes before mentioned, and that the said principal of One Hundred dollars to be held by the said trustees and their  succession forever And lastly it is my desire that this codicil be annexed to and made a part of my last will and testament as aforesaid to all intents and purposes in witness whereof I have hereunto set my hand and Seal this thirteenth day of March in the year of our Lord One thousand Eight Hundred and Seventy four
